Account - The separate bookkeeping record or records maintained by the Plan Administrator in the name of a participant in accordance with this Plan.

Administrative Agent - A&I Benefit Plan Administrators Inc., whose address is 1220 SW Morrison, Suite 300, Portland, OR 97205.

Board of Trustees - The individuals who govern the Harrison Electrical Workers Trust Fund and their successors.

Category II Agreement - A written agreement between the Board of Trustees and an employer that requires the employer to make contributions to the Plan for its employees who do not receive benefits pursuant to a collective bargaining agreement.

Code - The Internal Revenue Code of 1986, as amended.

Contributions - The payments an employer is required to make to the Trust, under the terms of a Category II agreement or collective bargaining agreement, so its covered employees may be eligible for one or more of the benefits offered by the Plan.

Dependent - Means:

1. An employee's spouse (f not legally separated from the employee). Coverage for the spouse ends on the date of the divorce or legal separation. Same sex spouses and same sex and opposite sex domestic partners are not covered.

2. Children

a) An employee's unmarried child (including a stepchild, legally adopted child or child placed in an employee's home pending adoption) from live birth until the end of the month the child attains age 19.

b) An employee's unmarried child (including a stepchild, legally adopted child or child placed in an employee's home pending adoption) who has attained age 19 if the child is:

(i) Mentally or physically unable to earn a living and proof of incapacity is furnished to the Board of Trustees within thirty-one (31) days of the date coverage would have ended due to age;

(ii) Single and actually dependent on the employee for the majority of his or her support; and

(iii) Covered by this Plan just prior to the day the child attains age 19.

c) An employee's unmarried child (including a stepchild, legally adopted child or child placed in an employee's home pending adoption) who is enrolled in an accredited school as a full-time student and has not attained age 25.

3. An employee's unmarried grandchild, niece, nephew or sibling in the custody of the employee and, for whom the employee is providing the majority of his or her support will be considered a dependent if the employee has been named as legal guardian by a court of competent jurisdiction until the end of the month the grandchild, niece or nephew attains age 19. Coverage for the grandchild, niece, nephew or sibling can continue beyond age 19 if the grandchild, niece or nephew meets the criteria in paragraph 2(b) or 2(c) above.

Dependent Care Expenses - Amounts paid by a participant for services that are employment related expenses as defined under Section 21 (b)(2) of the Code. Such amounts cannot be reimbursed or reimbursable by any other group or insured dependent care program. Additionally, the participant or his or her spouse may not use such amounts to obtain a credit against federal income tax for employment related expenses under Section 21 of the Code. Dependent care expenses do not include amounts paid by a participant to an individual who qualifies as a deduction under Code Section 151 for the participant or participant's spouse, or amounts paid to a child of the participant or participant's spouse that is under 19 years old at the close of the plan year in which amounts are paid.

Disability - The participant is wholly and continuously unable to perform each and every function of his or her employment and is under the care of a physician or surgeon.

Election Period - The period designated by the Board of Trustees for a participant to elect how contributions will be allocated between the wage replacement account and the premium reserve account, and the period designated by the Board of Trustees for a participant to allocate amounts in the premium reserve account to the Dependent Care Reimbursement Plan and Medical Expense Reimbursement Plan.

Eligible Expense - An expense incurred during a coverage period that is eligible for payment of reimbursement pursuant to each benefit provision, and that is not reimbursed to a participant outside this Plan.

Employee - A common law employee of an employer who receives wages as defined in Code Section 3401 (a) from an employer. The term employee does not include self-employed individuals defined in Code Section 401(c), partners of a partnership, independent contractors, or individuals holding a two percent or greater ownership in a corporation defined in Code Section 1361.

Employer - Each firm that has agreed to be bound by the collective bargaining agreement or Category II agreement that requires contributions to the Plan. Referred to as an employer contributing employer in this document.

ERISA - The Employee Retirement Income Security Act of 1974, as amended.

Harrison Health and Welfare Plan or Harrison Plan- The health and welfare plans the Board of Trustees have implemented or will implement for employees, early retirees, retirees and their dependents. The health and welfare plans currently offered by the Trustees are known as the Active Employee Plan and the Retired Trust Plan.

IBEW - The International Brotherhood of Electrical Workers.

Medical Expense - An expense incurred for medical care as defined under Code Section 213(d) but only to the extent such expenses are not reimbursed or reimbursable by an employer-provided accident or health plan, any other group or individual accident or health insurance, and to the extent such expenses are not used as deductions on the employee's federal income tax return.

NECA - the National Electrical Contractors Association.

Participant - An employee who commences participation in accordance with eligibility and participation provisions of the Plan.

Plan - The Harrison Electrical Workers Trust Fund Flexible Benefits Plan, as amended from time to time.

Plan Administrator - The Board of Trustees.

Retirement or Retired - An individual no longer working in the electrical industry and is a participant in a Medicare Supplement Plan as of January 1.

Surviving Spouse or Dependent - The spouse or dependent, as defined in the Harrison Health and Welfare Plan, of an Eligible Employee who dies while a Participant in the Plan.

Trustees - The individuals who govern the Trust Fund and their successors.

Trust Fund - The Harrison Electrical Workers Trust Fund.

Union - Local 48 of the International Brotherhood of Electrical Workers.
