The Harrison Electrical Workers Trust Fund Flexible Benefits Plan was designed to provide you with a variety of benefits that can be used to meet your individual circumstances. The Plan also allows you to take advantage of favorable tax rules for most benefits, which means you may avoid paying federal and state income tax. Please refer to the sections that describe each benefit for more information. This Summary Plan Description has been prepared to provide you with a summary of the structure, benefits and other information concerning the Flexible Benefits Plan. This summary is not meant to interpret, extend, or change the provisions of your Plan in any way. The provisions of your Plan may only be determined accurately by reading the actual Plan Document. A copy of your Plan Document is available through the Plan's administrative office and may be read by you, your beneficiaries, or your legal representatives at any time. In event of any discrepancy between this summary and the actual provisions of the Plan, the Plan shall govern. The Board of Trustees has discretionary authority to construe and interpret all provisions of the Plan and this Summary Plan Description, including but not limited to, eligibility to participate, eligibility for benefits, and amount of benefits, if any, to be paid. No individual Trustee, Union Representative, Employer Representative or employee of the Plan's Administrative Agent (A&I Benefit Plan Administrators) is authorized to interpret this summary for the Board of Trustees. The Board of Trustees as Plan Administrator has authorized employees of the Plan's Administrative Agent to respond informally to you or your dependents' written or oral inquiries on an informal basis. However, the written and oral answers are not binding upon the Board of Trustees. The Plan is intended to be a continuing and permanent program for participants, but the Board of Trustees reserve the right to modify, alter, amend or terminate this Plan, in whole or in part, at any time. This Plan will be construed in accordance with the Code and ERISA and regulations issued there under and, to the extent applicable, the laws of the state of Oregon.
